These Terms of Service (“Terms”) govern your access to and use of the SeatCheck mobile application and related services (collectively, the “Service”). In these Terms, “SeatCheck,” “we,” “us,” and “our” refer to the operator of the Service.
1. Acceptance of Terms
By creating an account, downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you represent that a parent or legal guardian has reviewed and agreed to these Terms.
3. The Service
SeatCheck is a community-driven platform that helps users discover cafes, libraries, and study spaces and share information such as check-ins, crowd levels, noise levels, amenities, and photos.
No reliance: The Service is informational and community-sourced. Do not rely on SeatCheck for safety-critical decisions, emergencies, or time-sensitive accuracy.
4. Account Registration and Security
To access certain features (including posting check-ins or content), you may need an account. You agree to:
Provide accurate information and keep it current.
Maintain the confidentiality of your credentials.
Notify us promptly of unauthorized access or security issues.
You are responsible for all activity under your account.
5. User Content and License
“User Content” includes any text, photos, check-ins, reviews, ratings, comments, or other material you submit.
Ownership: You retain ownership of your User Content.
License to SeatCheck: By submitting User Content, you grant SeatCheck a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for formatting and display), distribute, publicly display, and otherwise use your User Content to operate, improve, promote, and provide the Service.
Your representations: You represent and warrant that:
You own or have all necessary rights to submit the User Content, and
Your User Content does not violate any law or any third-party rights (privacy, publicity, copyright, trademark, etc.).
6. Content Rules (Prohibited Conduct)
You agree not to:
Post false, misleading, or deceptive information (including fake check-ins).
Harass, threaten, or abuse others; post hate or discriminatory content.
Post illegal content or encourage illegal activity.
Post spam, manipulate rankings/ratings, or coordinate fraudulent engagement.
Attempt to reverse engineer, scrape, disrupt, or overload the Service.
Circumvent moderation, safety features, or access controls.
Use the Service in violation of applicable laws.
We may remove content, reduce visibility, or take other actions at our discretion.
7. Moderation and Enforcement
SeatCheck may (but is not obligated to) review, remove, edit, block, or restrict User Content, and suspend or terminate accounts. We can do this for any reason, including violations of these Terms, risk to users, or legal/compliance reasons.
8. Intellectual Property
The Service, including its design, software, trademarks, and logos, is owned by SeatCheck and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, or create derivative works from the Service.
9. Third-Party Services and Links
The Service may integrate third-party services (e.g., hosting, analytics, maps, authentication) or link to third-party websites. We are not responsible for third-party services and your use of them may be governed by their terms.
10. Location Features
If you enable location permissions, the Service may use your device location to show nearby places and support location-based check-ins. You can disable location permissions in your device settings at any time (though some features may not work).
11. Account Deletion
You can request and initiate account deletion within the app (or via the method described in-app). We will process deletion in accordance with our Privacy Policy and applicable law. Apple requires apps that support account creation to also support in-app account deletion initiation.
12. Termination
We may suspend or terminate your access at any time. You may stop using the Service at any time and request account deletion.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEATCHECK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee accuracy, completeness, or reliability of user-submitted information, including crowd levels, hours, amenities, or availability.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEATCHECK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT WILL SEATCHECK’S TOTAL LIABILITY EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID SEATCHECK (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless SeatCheck and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms.
16. Changes to the Service or Terms
We may modify or discontinue the Service at any time. We may update these Terms from time to time. If changes are material, we will provide reasonable notice (e.g., in-app notice). Continued use after the effective date means you accept the updated Terms.
17. Governing Law
These Terms are governed by the laws of the State of California, excluding conflict-of-law rules, except where prohibited by law.
18. Apple iOS Additional Terms
If you use the Service on iOS:
These Terms are between you and SeatCheck, not Apple.
Apple has no obligation to furnish maintenance or support services.
In the event of a failure to conform to any applicable warranty (if any), you may notify Apple and Apple will refund the purchase price for the app (if applicable); Apple has no other warranty obligation.
Apple is not responsible for claims relating to the Service, including product liability, legal compliance, or consumer protection claims.
Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them.

20. Promotions, Rewards, and Verification
SeatCheck may offer promotions, rewards, sweepstakes, challenges, or other incentive programs (“Promotions”), including in partnership with third-party venues (each, a “Partner Venue”). Promotions may be subject to additional rules, eligibility requirements, and limitations presented in-app or at the time of participation, which are incorporated into these Terms.
Eligibility & limits. Promotions may be limited by time, geography, quantity, account, device, or venue (e.g., limits such as one reward-eligible check-in per venue per day). Rewards may be revoked if participation violates these Terms or applicable Promotion rules. Rewards have no cash value unless explicitly stated, are not transferable, and may not be sold or bartered.
Verification. To prevent fraud and confirm eligibility, SeatCheck may require verification steps, including (without limitation) scanning a QR code displayed at a Partner Venue, entering a rotating code, enabling location services, or other confirmation methods. Attempting to falsify check-ins, manipulate verification, exploit the system, or coordinate fraudulent activity may result in disqualification, forfeiture of rewards, removal of content, and suspension or termination of your account.
Changes, suspension, and cancellation. SeatCheck may modify, suspend, or end any Promotion at any time, with or without notice, to the extent permitted by law. SeatCheck may deny participation or redemption for suspected fraud, abuse, or error.
Partner Venue fulfillment. Rewards offered by Partner Venues are fulfilled solely by the Partner Venue and are subject to their availability, rules, and business operations (e.g., hours, inventory, staff discretion). SeatCheck is not responsible for Partner Venue refusal to honor a Promotion due to suspected fraud, operational constraints, or rule violations. Disputes regarding Partner Venue fulfillment should be directed to the Partner Venue, though SeatCheck may assist with troubleshooting at its discretion.
Taxes. You are responsible for any taxes, reporting obligations, or incidental costs associated with receiving or redeeming rewards.
PRIVACY POLICY

This Privacy Policy explains how SeatCheck collects, uses, shares, and protects information when you use the Service.
1. Information We Collect
We collect information in the following categories:
A. Information you provide
Account information: email, username, display name
Profile information: bio and preferences (if provided)
User Content: check-ins, ratings, reviews, comments, photos you upload
B. Information collected automatically
Device and app information (e.g., device identifiers, app version, operating system)
Log data (e.g., timestamps, feature usage, crash reports/diagnostics)
Approximate location derived from IP may be collected by standard server logs (varies by provider)
C. Location data (with permission)
If you grant permission, we collect precise device location to:
Show nearby places
Support location-based check-ins
You can revoke this permission in device settings.
2. How We Use Information
We use information to:
Provide and operate the Service (accounts, check-ins, saved places)
Personalize your experience (e.g., nearby results, preferences)
Moderate content and enforce rules (fraud prevention, abuse detection)
Improve reliability and performance (analytics, debugging, crash diagnostics)
Communicate with you (service notices; optional notifications if enabled)
Apple expects your App Store privacy disclosures to accurately reflect your data practices (including third-party SDK collection).
3. How We Share Information
A. Public/visible to other users
Depending on your settings and how the feature is designed, the following may be visible to other users:
Your check-ins, ratings, reviews, and photos
Your display name/username (unless you use anonymous posting, where available)
B. Service providers
We share information with vendors who help us operate the Service (e.g., cloud hosting, databases, analytics, customer support tools). They are authorized to process data only on our instructions and for the purposes described here.
C. Legal and safety
We may disclose information to comply with law, protect rights and safety, investigate fraud/abuse, or respond to lawful requests.
We do not sell your personal information. If our practices change, we will update this policy and provide any required choices.
4. Anonymous Posting
If you post anonymously, other users will not see your display name. We still retain the internal association between your account and the post for moderation, abuse prevention, and legal compliance.
5. Data Retention
We retain information as long as needed to:
Provide the Service
Comply with legal obligations
Resolve disputes and enforce agreements
Retention varies by data type; we may retain certain records (e.g., anti-fraud logs) for a reasonable period even after account deletion where permitted by law.
6. Account Deletion
You can initiate account deletion within the app. After deletion:
Your account will be disabled and scheduled for deletion
Some information may be retained as described in Data Retention (e.g., legal compliance, security, fraud prevention)
Public User Content may be removed or de-identified depending on how the feature is implemented; the app should describe this in the deletion flow
Apple requires that apps offering account creation allow users to initiate account deletion in-app.
7. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect your information. However, no system is 100% secure and we cannot guarantee absolute security.
8. Your Choices
Location: control via device permissions
Notifications: control via device settings and in-app settings (if available)
Profile: edit within the app
Account deletion: initiate within the app
9. Children’s Privacy
SeatCheck is not intended for children under 13 and we do not knowingly collect personal information from children under 13. If you believe a child provided personal information, contact us to request deletion.
10. California Privacy Notice (CCPA/CPRA)
If you are a California resident, you may have rights to:
Know/access the personal information we collect about you
Request deletion (subject to exceptions)
Correct certain information
Opt out of “sale” or “sharing” if applicable
We do not sell personal information, and we do not share personal information for cross-context behavioral advertising as of the date of this policy. If that changes, we will provide required opt-out mechanisms (e.g., “Do Not Sell or Share My Personal Information”).

11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If changes are material, we will provide reasonable notice (e.g., in-app notice). Your continued use after the effective date means you acknowledge the updated policy.

13. Promotions and Verification Data
If you participate in Promotions (such as rewards for verified check-ins), we may collect and process information needed to administer and protect those Promotions, including: promotion participation status; check-in and redemption events; Partner Venue identifiers; timestamps; verification tokens (such as QR scan confirmations or entered codes); and signals used for fraud prevention (such as device/app identifiers, IP address, and location data if you have enabled location permissions).
How we use it. We use this information to: (a) verify eligibility and prevent fraud or abuse; (b) track and display your promotion progress (e.g., stamps/credits) in-app; (c) troubleshoot support requests and handle disputes; (d) enforce our Terms and Promotion rules; and (e) analyze aggregate performance of Promotions.
Sharing with Partner Venues. When a Promotion involves a Partner Venue, we may share limited information with that Partner Venue to confirm eligibility and redemption (for example: confirmation that a redemption is valid, the venue location, and the timestamp). We do not need to share your email to validate a redemption.
Retention. We retain Promotion and verification records for as long as necessary to operate Promotions, prevent fraud, comply with legal obligations, and resolve disputes. We may retain certain records after account deletion where permitted by law (for example, for fraud prevention and compliance).
